Terms of Service

These Terms of Service ("Terms") govern your use of TokSpark ("the Service"), operated by TokSpark ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service.

2. The Service

The Service is a TikTok content research tool that provides:

• Creator hit breakdowns — analysis of a creator's recent top-performing content.
• Trending topic library — topic ideas for a keyword or niche.
• Competitor differentiation analysis — comparison of competitor content and suggestions.

Results are generated by fetching public TikTok data through the third-party TikHub API and processing it with AI language models.

3. Your Inputs

3.1 What You Submit

You provide creator links, keywords, or competitor links (and optional notes) to run a query. You agree that:

• You will only submit links and keywords you are permitted to use.
• You will not use the Service to infringe anyone's copyright, trademark, privacy, or other rights.

3.2 No Ownership Over Results

We claim no ownership over the analysis generated for you. You may use the output for your own content planning, subject to these Terms and to the rights of third parties (for example, don't copy someone else's script verbatim; use our breakdowns to inform your own original content).

4. Acceptable Use

You agree not to:

• Use the Service for illegal, harmful, or abusive purposes.
• Attempt to reverse-engineer, decompile, or extract the Service's underlying code or models.
• Attempt to bypass rate limits, quotas, or our cost-protection mechanisms.
• Automate the Service in ways that abuse the TikHub API or exceed normal human use.
• Submit content you do not have the right to use.

5. Third-Party Services (TikHub API)

• The Service relies on the TikHub API (api.tikhub.io), a paid third-party service, to fetch public TikTok data.
• Costs: TikHub API is billed per request. Where you run queries with your own TikHub API key, you are responsible for those costs. Where queries are run for you, applicable product fees apply.
• Cost preview: before any paid batch query, the Service shows a cost preview so you can decide before running.
• Data use: data fetched is used only for the query you run. TikHub's own terms and privacy policy apply to its handling of data.
• We are not responsible for TikHub API availability, accuracy of the data it returns, or its terms.

6. Disclaimers

6.1 Research Aid Only

The Service provides research and ideation aids. Results are generated from public platform data and AI analysis and may be inaccurate, incomplete, or out of date. You should verify any result before relying on it.

6.2 No Professional Advice

The Service's output is provided for content selection and ideation reference only and does not constitute commercial, legal, financial, or investment advice. See our Input Disclaimer.

6.3 "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TokSpark BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

8. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by TokSpark and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted. Third-party trademarks are referenced only to describe interoperability, never to imply endorsement.

9. Termination

We may suspend or terminate access to the Service if you violate these Terms, with notice where practicable. You may stop using the Service at any time.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on the Service at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
